White Collar Investigations and Defense
Marc began his career as a professional investigator and trial attorney in 1998 when he started as an Assistant State Attorney for Miami-Dade County, Florida. As a prosecutor, Marc learned through extensive experience and practice how to identify, preserve and collect relevant evidence to build a compelling case that would be tested and evaluated by a jury. One of the most important skills that Marc learned as a prosecutor, and continues to hone today, is that of interviewing witnesses to uncover facts, particularly when the witnesses do not want to share those facts with the interviewer. Marc also learned how to effectively organize and present the findings of complex investigations to judges and juries at trial. Indeed, Marc tried many of the cases that he investigated while serving as a state prosecutor. After leaving the Office of the State Attorney in 2002, Marc went into private practice where he was able to apply the skills and experience that he gained as a prosecutor for the benefit of private companies, organizations and individuals in white collar investigations and criminal defense matters. After working as an associate for five years in the white collar practice group of a respected national law firm and having most recently served as a co-chair of the white collar practice group of one of Philadelphia's most prestigious regional law firms, Marc now provides his advice, counsel and advocacy in white collar investigations and defense matters to organizations and individuals through his own firm, as described in further detail below.
Conducting Internal Investigations for Companies and OrganizationsWhether triggered by a whistleblower, a tip, an audit or the service of a government-issued subpoena or search warrant, privately held companies and organizations often need experienced advice and counsel to conduct legally privileged investigations to find facts and determine whether officers, employees or contractors engaged in misconduct and, if so, gauge the resulting risks for the organization. Organizations that conduct internal investigations also need professional guidance to make the important decisions of whether to disclose investigation findings to stakeholders or government authorities, how to respond to the findings internally and how to prepare to defend against potential charges or allegations. Marc has substantial experience conducting thorough and fair internal investigations for organizations ranging from Fortune 100 companies to small nonprofit organizations, and guiding them through the important process of deciding whether to disclose investigation findings and pursuing strategies that provide the greatest protections for the organization in the process.

Counseling Individuals in Internal InvestigationsIndividual officers, employees and contractors of companies and organizations can find themselves in difficult situations when asked to answer questions and provide evidence in high-stakes internal investigations that relate to their careers and livelihood. Companies and organizations conducting internal investigations often agree to pay for officers and employees to hire their own attorneys to protect and guide them through the internal investigations process, including to represent them during investigative interviews. Having conducted numerous internal investigations on the organizational side as well as represented scores of individuals in criminal and internal investigations, Marc is ideally suited to represent individuals in internal investigations. Marc can quickly identify the risks posed to the individual by the internal investigation and provide advice and counsel on the individual's rights and options in response to the organization's request for the person to submit to an interview and provide other evidence in the investigation. Marc will also advocate on behalf of the individual to ensure that the company or organization treats the officer or employee fairly and appropriately.

Representing Individuals in Criminal InvestigationsBeing the subject or target of criminal investigation is a nerve-wracking and intimidating situation for any person. Worse yet, being charged and publicly accused of criminal conduct and having to either fight for an acquittal at trial or negotiate a plea agreement can be an extremely harrowing and terrifying experience. Marc is a well experienced and effective counselor and advocate who can provide meaningful advice to clients to help them avoid criminal prosecution in the first instance. Marc has worked with numerous clients who were under investigation for serious criminal offenses, but ultimately succeeded in convincing the government not to bring charges against them. If charges cannot be avoided or have already been filed, Marc is equally effective at negotiating favorable plea agreements with the goal of achieving the most lenient sentence possible. However, if a client wants to have a judge or jury decide the outcome of their case, Marc is a zealous advocate who will relentlessly fight to exonerate his clients through trial. Marc will ensure that his clients obtain a fair trial and that their defenses are thoroughly presented at trial.
